Real estate ownership in Turkey

Law No. 35 of the Land Registration Law No. 2644, amended by Law No. 6302, which came into force as of 18/5/2012 AD, is the legal basis for real estate investment in Turkey, which allows foreigners to own real estate in Turkey.

Legal restrictions on foreign ownership of real estate in Turkey

1. Foreigners are allowed to own a maximum of 30 hectares, and a hectare is equivalent to 300,000 square meters at the level of Turkey.

2. Foreigners are not entitled to own or rent property within 400 meters of all the military barracks of the Turkish army and strategic and security locations such as airports, seaports, oil and energy stations, and other cultural and religious centers of the Turkish state.

3. Foreigners can buy real estate in a region or town with a maximum of 10% of the total lands in this region or town.

Procedures for owning real estate in Turkey

1. Choosing the right property.

2. Verify the following information:

o Title deed or title deed.

o Location statement: a copy of the property's location in the municipality plan.

o The property number according to the municipal plan.

o The absence of any restrictions that impede the sale of the property, such as mortgages or inheritance issues.

3. Issuing a tax number.

4. Translating the passport into the Turkish language and attesting it

5. Contracting a “commitment to sell agreement”

6. Go to the Land Registry Department "Tapu Department" when sending the appointment letter

Documents to be provided upon purchase

Documents to be available with the seller

A "property value statement document" to be obtained from the competent municipality.

A recent personal photo of size 4×6 cm, not more than 6 months old.

A copy of the project's building permit and its registration document in the municipality.

· Copies of all company documents such as: company establishment license - a copy of the commercial register.

Real estate insurance certificate against earthquakes.

Documents to be available with the buyer

Obtaining a tax number. (Vergi No)

The passport with a translation into Turkish by a sworn translator and certified by the Notary Public.

2 recent personal photos measuring 4 x 6 cm, not more than 6 months old.
